A NEW PROFORMA (ANF) HAS BEEN CREATED FOR SUBMITTING APPLICATIONS FOR REVALIDATION OF SCOMET EXPORT AUTHORIZATIONS

The Directorate General of Foreign Trade (DGFT) announced a new proforma, ANF 2O(d), for filing applications for revalidation of Special Chemicals Organisms Materials Equipment and Technologies (SCOMET) export permission. The new ANF proforma will make it easier for trade and industry to submit applications for SCOMET export authorization revalidation. The request for revalidation of SCOMET permission can be made up to 30 days before the authorization expires. The term of authorization renewal will be calculated from the date of the authorization’s actual expiration, resulting in a shorter period of validity for late-submitted applications. The entire validity duration must not exceed 12 months in any instance.

SOP FOR DEALING WITH WRIT PETITIONS IN THE CASE OF FACELESS ASSESSMENTS

The National Faceless Assessment Centre (NaFAC) and the Central Board of Direct Taxes (CBDT) have released the Standard of Procedure (SOP) for dealing with writ petitions where an assessment is made under the Faceless Assessment Scheme 2019 (FAS’ 19)/Section 144B of the Income Tax Act, 1961, or a penalty is imposed under the Faceless Penalty Scheme (FPS), 2021, and NaFAC or the Central Board of Direct Taxes are one of the respondents.

Within 5 days of receiving a writ petition directly from the petitioner, Standing Counsel, the High Court, or the CIT (Judicial) concerned, a copy shall be forwarded to the PCIT (Jurisdictional) in case proceedings are completed, and to PCIT (ReFAC) (AU) in case of proceedings are pending [with a copy to PCIT (Jurisdictional)].

The NaFAC shall authorize the PCIT (Jurisdictional) to defend the case before the High Courts in light of the CBDT’s communication dated August 14, 2020.

The NaFAC shall assess whether the request is accompanied by terms of reference for requesting comments from the PCIT (Jurisdictional) on policy topics or provisions pertaining to FAS 2019/section 144 of the Act or FPS, 2021 being challenged upon receipt of the request from the PCIT (Jurisdictional). Analyze the writ petition and provide responses to the petition’s main policy points. Before sending a response to the PCIT (Jurisdictional), NaFAC may refer the petition to the CBDT and Directorate of Legal and Research, and receive feedback from the relevant division.
